Spammer feels harassed

An online marketer based in Cape Town, when a victim of his unsolicited e-mail asked to be removed from future mailings, threatened to sic his lawyers on the victim for harassment. The case casts light on the law that governs such e-mail.

A test case may be brewing of the anti-spam provisions in the Electronic Communications and Transactions (ECT) Act. Section 45 of this Act is designed to protect consumers from the scourge of spam, or “unsolicited commercial communications”.

Lawyer Ryk Meiring estimates that between 60 and 80 percent of all e-mail constitutes spam, and that lost productivity due to spam costs South African businesses between R7 billion and R13 billion per year.
